Attorney’s Fees and Costs

Parties are entitled to recover attorney’s fees in Louisiana when provided by for contract or authorized by statute. There are a number of statutes that provide for recovery of attorney’s fees in connection with construction disputes: La. R.S. 38:2191; La. R.S. 48:251.5; La. R.S. 38:2246; La. R.S. 48:256.11; La. R.S. 9:278.4; La. R.S. 9:4856; La R.S. 38:2220.4. In arbitration, the Construction Industry Rules of the American Arbitration Association provides broad authority for the arbitrator to award fees and costs when requested.
