Prompt Payment Claims

While we represent general contractors on both public and private projects, we have also represented subcontractors, suppliers, lessors, equipment dealers, or other parties involving liens and privileges under the public works acts, Title 38 and Title 48 of the Louisiana Revised Statues, or the private works act, La. R.S. 9:4801, et seq. Under Title 38 and Title 48, a concursus action is to be filed as a summary proceeding at the end of the lien period to resolve outstanding claims as defined by law. Under Title 38, the claimant may recover a 10% penalty if it recovers all the sums demanded, but under Title 48, a claimant may recover reasonable attorney’s fees, La. R.S. 38:2246; La.
